    The lawsuit filed by several Residential Owners against The Mark is still pending.

    The lawsuit between the Commercial Unit Owner and the Plaintiffs and the Crossclaim filed by the Commercial Unit Owner against The Mark have been resolved.

    Documents filed with the Court are public record including the Permanent Injunction entered by Judge Fox against The Mark Board of Directors.

    The Parties attended a settlement conference on May 13, 2025 to further explore a resolution of the lawsuit. Some progress was made but the case did not settle.
